Please read these terms and conditions (or “Terms and Conditions”) carefully before using our Website. By registering on the Website or by visiting the Player Account by logging in Players accept and agree to these Terms and Conditions and the Privacy Policy as amended from time to time. The Terms and Conditions and the Privacy Policy are published on the Website and may be changed at any time. The new version of these Terms and Conditions and the Privacy Policy will take effect immediately upon the next visit or login on the Website.
The Website enables Players to place Bets on global Financial Market data such as of the New York Stock Exchange and to Enter into Games of KenoGo. Lottoland holds an online sports betting license issued by the Northern Territory of Australia under the Racing and Betting Act 1983 (NT) (“NT Betting Licence”) and a Keno Licence issued by Victoria under the Gambling Regulation Act 2003 (“Victorian Keno Licence”.)
Lottoland is not a financial institution. When Betting with Lottoland, Players are Betting on certain Financial Market data.
These Terms and Conditions (https://www.lottoland.com.au/terms) only apply to Players that are residents in Australia. International residents seeking to place Bets will be subject to the terms and conditions at https://www.lottoland.com/en.
Lottoland is responsible for the operation of the Website, the Player Accounts, the placing and acceptance of Bets, the acceptance of Entries, taking Players’ Stakes and forwarding of Winnings to the Players within the scope of these Terms and Conditions.
With respect to Betting, Lottoland acts as a bookmaker, determines the odds, calculates the Winnings and is responsible for the payment of Winnings and pays out the Winnings. Through complex hedging measures and instruments, Lottoland guarantees the payout of all Winnings for Bets placed. Lottoland also guarantees the payout of all Winnings for Entries into Games.
At the time of registration, the Player enters a contract with Lottoland in relation to the use of the Website, the set up and the management of their Player Account, the placing of Bets, Entries into Games, the payment of the Player’s Stakes and the payout of Winnings to the Player. When Lottoland accepts a Player’s Bet or Entry, the Player enters a contract with Lottoland regulating the terms and conditions for all Bets or Entries accepted.
In relation to Bets, the Player pays Lottoland a Stake which is fully claimed by Lottoland acting as a bookmaker. For Games, the Player pays Lottoland a Stake which is fully claimed by Lottoland as the operator of KenoGo. In both cases, the player does not have to pay any fees for Lottoland’s services.
The introduction, namely all provisions above and the definitions contained below, apply to the entirety of these Terms and Conditions.
“Bank Account” – the bank account of a commercial credit institution provided by the Player and linked to the Player Account.
“Bank Card” – a prepaid, debit or credit card or any other card with a payment and/or credit function and used as a payment method.
“Bet” – a bet accepted by Lottoland on the outcome of a certain real event in accordance with its NT Betting Licence, for example a set of Financial Market data at a set point in time, as offered by the Website and submitted directly or indirectly, via internet, telephone or other channels and “Betting” has a corresponding meaning.
“Betting Event” – the events Lottoland makes available to Players as described in clause 2 and on which Bets may be placed.
“Betting Rules” means the rules that govern Players making a Bet, found at https://www.lottoland.com.au/terms.
“Betstop” – the National Self-Exlusion Register. “Corporations Act” means the Corporations Act 2001 (Cth).
“DoubleJackpot” – an additional option that a Player can select on the Virtual Play Slip which doubles the Player’s entitlement to a Jackpot. On one Virtual Play Slip, only DoubleJackpot or NumberShield can be played, and not both.
“Entry” means the entry by a Player into a Game or series of Games by completing the purchase of a Ticket and Entries, Entered and Entering have corresponding meanings.
“Excluded List” means any of the following:
(a) any person citizen of or resident in a country listed by the Financial Action Task Force (FATF) as posing a risk to the international financial system as set out in the ‘Countries’ section of www.fatf-gafi.org under "High risk jurisdictions subject to a call for action" and “Jurisdictions under "Increased Monitoring” as varied from time to time by FATF;
(b) any person listed on the financial sanctions list of Her Majesties Revenue & Customs, as varied from time to time; and
(c) any person citizen of or resident in the United States of America.
“Financial Market” – any recognised regulated stock exchange or market where buyers and sellers participate in the trade of financial assets and instruments such as equities, shares, bonds and currencies.
“Game” means a single game of KenoGo.
“Jackpot” – in the case of a Bet, the maximum possible Winnings at Lottoland in respect to relevant Betting Event of the advertised relevant Prize Category/Prize Categories of the relevant Betting Event or the sum thereof without the option DoubleJackpot. Jackpots can be fixed to an amount chosen and advertised by Lottoland.
“KenoGo” means the keno game “KenoGo” conducted by Lottoland under and in accordance with the Keno Licence.
“KenoGo Rules” means the rules that govern Players Entering into a Game, found here.
“Licences” means the NT Betting Licence and the Victorian Keno Licence.
“Lottoland” – Lottoland Australia Pty Ltd, an Australian Private Company (ABN 14 602 590 429), registered office address: Level 7, 151 Clarence Street, Sydney NSW 2000, Australia.
“Lottoland Winning Bet” – a winning Bet for a Betting Event, which was successfully submitted directly or indirectly, via Internet, telephone or other channels, and accepted by Lottoland in accordance with these Terms and Conditions and including winning Syndicate Bets.
“NumberShield” – an additional option that a Player can select on the Virtual Play Slip which guarantees the Player’s entitlement to undivided Winnings in case of other winners. On one Virtual Play Slip, only NumberShield or DoubleJackpot can be played, and not both.
“NT Betting Licence” has the meaning given by the Foreword.
“Pay Out” – the amount, which is paid or payable in accordance with these Terms and Conditions in respect to a correctly matched Bet on a Betting Event in a relevant Prize Category.
“Player” – a registered user of the Website.
“Player Account” – the notional account created by a Player on the Website through which the Player can place and pay for Bets and Enter into Games on the Website.
“Privacy Policy” – the valid policy published by Lottoland in respect of the use and storage of personal information, which is incorporated by reference into these Terms and Conditions.
“Prize Category” or “Prize Tier” – the numbers correctly bet on which determine the prize category or tier in respect of the relevant Betting Event.
“Related Body Corporate” has the meaning given by section 50 of the Corporations Act.
“Rules” means each of the Betting Rules and the KenoGo Rules.
“Share” – refers to a share in a Syndicate Bet.
“Special Jackpot” – the highest possible win in the highest Prize Category (without activation of the feature “DoubleJackpot”) communicated by Lottoland in regards to a Betting Event.
“Stake” – this refers to (as the case may be):
(a) in respect of Betting, the sum of money the Player decides to bet in respect of a Bet or
(b) in respect of playing KenoGo, the sum of money the Player decides to stake in respect of a Game or Games.
“Syndicate Bet” - this refers to a group of numerous Bets on a certain real event, or multiple certain real events, in which Shares are available for purchase by a Player.
“Ticket” means the serial numbered digital ticket which a Player uses to make their selections for a Game or Games, which records all the particulars of an Entry.
“Victorian Keno Licence” has the meaning given by the Foreword.
“Virtual Play Slip” – the electronic play slip on the Website to bet on a Betting Event.
“Website” – the Internet portals of Lottoland, which are accessible at www.lottoland.com.au, KenoGO.com.auand any related mobile applications in respect of either Lottoland betting or KenoGo.
“Winning Entry” means an Entry that wins a prize in accordance with the KenoGo Rules, and as further described in Rule 12 of the KenoGo Rules.
“Winnings” – this refers to the amount of money to be paid to the Player in respect of either (as the case requires):
(a) Lottoland Winning Bet, including Jackpot; or
(b) Winning Entry.
Unless the context clearly requires a different understanding, words used in one genus are to be understood in another genus as well.
In the event of any inconsistency between these Terms and Conditions and the KenoGo Rules, the KenoGo Rules shall for all intents and purposes prevail.
2.1 Each Player warrants at all times that:
(a) they have read, understood and agree to the Terms and Conditions, and
(i) if they place a Bet, they have read, understood and agree to the Betting Rules; and
(ii) if they Enter into a Game, they have read, understood and agree to the KenoGo Rules;
(b) they are not under 18 years of age (under-age gambling is an offence);
(c) if they:
(i) place a Bet, they are not a resident in South Australia; and
(ii) Enter into a Game, they are a resident of Australia;
(d) by Entering into a Game or placing a Bet, they are not contravening any valid local law to which they are subject;
(e) they are aware that they might lose their Stake submitted via the Website;
(f) they are not depositing monies originating from criminal and/or other un-authorised activities;
(g) they will pay any taxes due on Winnings;
(h) they are not persons on the Excluded List;
(i) the details provided by them at the point of registration and payment respectively are complete, accurate and have not been stolen or lost;
(j) they are at the time of placing their Bet or Entry into a Game not a director, officer, or employee (or their spouse or dependant) of Lottoland; or any Related Body Corporate of Lottoland or one of the Lottoland Group companies or a contractor or service provider of Lottoland or any Related Body Corporate of any of the Lottoland Group who is deemed by Lottoland to be in a sensitive position;
(k) they are not restricted by limited legal capacity; and
(l) they only have one Player Account at Lottoland.
Lottoland is entitled to void a Bet or disqualify an Entry at any time if the Player is found to be or have been in breach at any time of any of these warranties, including, for the avoidance of doubt, even after a relevant Betting Event or Game has taken place which would have entitled the Player to certain Winnings except for a breach of these warranties.
2.2 The Player needs to register on the Website in order to use all services, place Bets or Enter into Games. Lottoland reserves the right to refuse the completion of the registration for any person.
2.3 The Player may be required to provide the following data in the course of registration of a Player Account, depositing funds into the Player Account, placing or accepting a Bet or Entering into a Game, or in relation to payout of Winnings: full name, residential address, gender, date of birth, email address, telephone number, payment method data as well as other information relevant or necessary for the realisation of services provided by Lottoland. Any personal information collected about, or provided by, the Player will be dealt with in accordance with Lottoland’s Privacy Policy, accessible at: https://www.lottoland.com.au/privacy.
Lottoland is required under the conditions of its Licences and under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) to verify a Player’s age and identity when a Player opens an account, and prior to any deposits being made into an account. By providing this data the Player grants Lottoland permission to verify the data provided, including the verification of their age, identity or other information provided, directly through Lottoland or through specialised third party providers. The Player acknowledges and agrees that Lottoland may: (a) request the Player to provide further information about or relevant to the Player which may be reasonably required to verify the Player or information about or relevant to the Player; (b) suspend, terminate or close a Player Account where the Player refuses to provide information reasonably requested by Lottoland.
The Player is required for ensuring that the data or information recorded in relation to their Player Account is complete, correct, up to date and accurate. The Player must inform Lottoland about any changes to the data or information provided, including but not limited to Bank Cards and Bank Accounts, by updating their Player Account. A Player may change or update their personal information and details at any time by accessing their Player Account on the Website.
Lottoland is not responsible for failure of payout due to non-provision of data or information by the Player, or the provision of missing, incorrect, incomplete or expired data or information. Lottoland is under no obligation to verify any data or information provided or to make contact with a Player to complete or change incorrect, incomplete or invalid data or information.
Lottoland is entitled to suspend the Player Account if identification verification is not completed after the opening of that Player Account. The Player acknowledges and agrees that if Lottoland is unable to verify the Player’s age and identity within the relevant period, Lottoland is required to suspend the Player Account in accordance with these Terms and Conditions. The Player understands and agrees that, until the required information has been provided to Lottoland’s satisfaction, the Player will not be able to deposit or withdraw any funds into or from their Player Account, place any Bets, Enter any Games or close their Player Account. Whilst the Account remains open, we may also be required to verify the Player’s identity and any credit/debit card or bank account linked to the Account, and if so, we will explain the reasons for this.
In any case where the Player is identified as not over 18 years of age, Lottoland must return any deposited funds and immediately close the Player Account for that person.
2.4 The Player shall immediately inform Lottoland if their Bank Card or a comparable payment method, which they have specified on the Website, becomes lost, suspended or stolen; the same applies, if relevant passwords or confidential information has been submitted to third parties.
2.5 Lottoland is entitled to request proof that a Player has authority to use any paying instrument which is linked to their account.
2.6 By placing a Bet or Entering into a Game, the Player agrees to comply with the relevant Rules, being the Betting Rules for betting and the KenoGo Rules for Entering into a Game.
3.1 The Player provides an email address and a password in the course of registration. The Player may self-manage their data or information at any time through the relevant Player Account.
3.2 Players are not permitted to have more than one Player Account at any one time. If an additional account or accounts are or were opened by a Player and/or Payment details are used in multiple Player Accounts, Lottoland will be entitled in its sole discretion to close any such accounts without notice. Lottoland shall be entitled to void any bets made by that Player.
3.3 The one Player Account must be used for both placing Bets and Entry into Games.
3.4 Lottoland shall be entitled in its sole discretion to define different minimum and maximum amounts for deposits and Stakes during a particular time period for a particular Player
3.5 The Player must keep their Player Account data (Player number, username and password) in a safe place in order to prevent unauthorised access. The Player is responsible for all activities and transactions conducted through their Player Account.
3.6 The Player is neither authorised to grant third parties access to their Player Account nor to use third parties’ Player Accounts.
3.7 It is the Player’s obligation to report suspected fraud or illicit use of their Player Account to Lottoland, and to take such steps as may be required in order to overcome it, such as by changing the password on the Player Account.
3.8 The Player may close their Player Account permanently on the Website by using the facility in the “My Account” section on the Website or by contacting Lottoland’s Customer Service. Any open or running Bets or open Entries linked to the relevant Player Account at the time of the closure will still stand, and any subsequent Winnings will be credited to the Player Account. The Player can contact Lottoland’s Customer Service in order to withdraw any remaining balance on the Player Account after closure. If the Player closes their Player Account, it is at Lottoland’s discretion to allow the Player to register a new Player Account.
3.9 The Player can see a list of all their active and expired Bets under the “My Activity” section on the Website. A Bet is only considered accepted by Lottoland if the status of the play slip has the label “In Play” or a status with an identical meaning. The order receipt confirmation sent by email or the status “Submitted” or a status with an identical meaning only indicates that Lottoland has received the order for a Bet, not that it has been accepted. Only with a status like “In Play” in the overview the Bet is considered accepted. In case that a Bet is not accepted, Lottoland will refund the value of this Bet to the Player.
3.10 The Player can also see a list of all their upcoming, active and previously played Tickets under the “My Tickets” section after clicking on the “My Account” section. Each Ticket will have a status of “No win”, “Won” or a blank status, indicating it is yet to be played. By click through to the “My Transactions” section, the Player can see a list of all Games played and the total Stake for each Game.
3.11 Lottoland is dedicated to providing its Players with an entertaining but safe and responsible gambling experience. Lottoland therefore provides a number of measures to assist Players who wish to take control of their gambling activity with Lottoland including temporary suspension, voluntary self-exclusion measures and deposit limit measures. Some of these responsible gambling measures are set out below. 3.12 The Player can lock their Player Account at any time for any reason, including if the Player wishes to voluntarily self-exclude themselves from placing Bets or Entering Games with Lottoland for a certain period of time (“Temporary Suspension” or “Self-Exclusion”).
3.13 The Player may make a request for Temporary Suspension or Self-Exclusion by using the relevant online facility after logging into the Player Account on the Website, accessing the “My Account” section of the Player Account and clicking the “Edit” button next to account status. The Player may determine the duration of their Temporary Suspension or Self-Exclusion, however the minimum self-exclusion period is six (6) months.
3.14 Alternatively, the Player may choose to self-exclude themselves from Betting voluntarily by following the self-exclusion process set up by the Northern Territory regulator at: https://nt.gov.au/industry/gambling/self-exclusion-from-a-sports-bookmaker-or-betting-exchange-operator. If the Player chooses to send a self-exclusion request through the Northern Territory process, the self-exclusion request will be applied by all gambling operators licensed in the Northern Territory (including Lottoland) in accordance with the Northern Territory licence conditions.
3.15 In line with the Federal Government’s National Consumer Protection Framework for online wagering providers, we have opted to implement BetStop. The Player may choose to use the free Australian Government initiative to block themselves from all licensed Australian Wagering Service providers.
3.16 The Player understands and agrees that by choosing to self-exclude, their Player Account will be locked immediately and the Player will not be able to access their Player Account, use any of the products or services offered on the Website, deposit or withdraw any funds from their Player Account, place any Bets or (where the Player has self excluded via the Website in accordance with the process outlined in clause 3.13) Enter any Games on the Website.
3.17 When a Player self-excludes, and subject to all necessary identity and account verification checks being made:
(a) any Bets which have been placed by the Player on Betting Events which have not yet occurred will still stand;
(b) any Entries by the Player into Games which have not yet occurred will still stand,
and any balance in the Player Account, including any Winnings in relation to Bets placed on Betting Events and Entries into Games which had not yet occurred at the time of the self-exclusion, will be returned to the Player Account. The Player can contact Lottoland’s Customer Service in order to withdraw any remaining balance on the Player Account after self-exclusion.
3.18 During the Player's self-exclusion period, Lottoland will not send any marketing materials to the Player unless and until the Player has unlocked their Player Account following the expiry of the self-exclusion period. The Player may not unlock or reopen their Player Account until after the expiry of the selected self-exclusion period.
3.19 The reopening of Player Accounts that have been self-excluded is only possible after the expiry of the Self-Exclusion period. For reopening their Player Account at the end of the self-exclusion period, Players must contact Lottoland’s Customer Service. Any request to unlock a Player Account will be subject to a 24-hour waiting period.
4.1 Betting or Entering into Games with no account balance or with a negative account balance is not possible.
4.2 With a direct debit order and authorisation respectively, the Player entitles Lottoland or its appointees the authorisation to debit the relevant amount from the Bank Account provided by the Player.
4.3 In case of a returned direct debit Lottoland may reject the acceptance of further payments. Lottoland is entitled to transfer claims against a Player, including possible additional but appropriate fees to a collection agency.
4.4 Any third party bank and payment processing charges and fees are borne by the Player and Lottoland is entitled to debit the Player Account accordingly. This also applies to foreign exchange charges.
4.5 Lottoland will credit payments from Players to Lottoland’s bank account immediately upon receipt of funds. The Player has to state their player number with all bank transfers.
4.6 In case a payment to Lottoland from a Player Account of a Player is ceased, interrupted, returned or for any other reasons not finalised or in case that such payment is cancelled afterwards or theft or fraud is obvious in this regard, Lottoland shall be entitled to debit the relevant amounts, including possibly existing additional fees imposed, to Lottoland.
4.7 The credit balance of a Player’s Account does not bear interest.
4.8 The Player can directly withdraw funds that constituted Winnings under the My Transactions section. In order to mitigate money laundering or fraud, funds from unspent deposits can only be withdrawn by contacting Customer Service Under no circumstances will a Player be able to withdraw any bonus funds in their Player Account.
4.9 A Player can only withdraw funds to a bank account in the name of the Player Account holder.
4.10 The credited amount deposited by the Player and the payable credit balance on the Player Account respectively are held in a bank account in the name of Lottoland and are not subject to any particular escrow or mechanisms for protection in the event of insolvency.
4.11 Lottoland is entitled to debit the Player Account with appropriate expenses which refer to any costs incurred by Lottoland in relation to exercising its rights under these Terms and Conditions.
4.12 Lottoland shall be entitled to deem a Player Account as inactive if more than one year has passed since the last Stake transaction of the Player. Lottoland will notify the Player once their account is deemed as inactive. A Player Account still deemed as inactive 28 days after the notification incurs a monthly administrative fee of 10.00 AUD. Lottoland is entitled to deduct this monthly administrative fee in its sole discretion until there is a new Stake transaction on the Player Account. The monthly administrative fee only applies to Player Accounts with a balance.
5.1 Lottoland shall be entitled to suspend the relevant Player Accounts and Players from the use of the Website with immediate effect, if Lottoland believes that a Player breaches, or is in breach of the requirements of these Terms and Conditions or the Rules. In addition, Lottoland shall be entitled to suspend the relevant Player Accounts and Players from the use of the Website, if Lottoland believes that:
(a) the Player has provided false or misleading information in connection with their Player Account, any payment methods or otherwise in connection with the Website and the services available through it;
(b) the Player maintains or maintained more than one Player Account, including if the Player maintains or maintained a separate Player Account to place Bets and Enter into Games;
(c) the Player is involved in any fraud-related activity;
(d) the Player is or was in breach of any other provision of these Terms and Conditions or the Rules;
(e) the Player has used the Website in a fraudulent manner or for illegal and/or unlawful or improper purposes including but not limited to if Lottoland has reasonable suspicion that a Player is abusing or attempting to abuse a bonus, offer or other promotion form or taken advantage of any software or system bug, malfunction or failure;
(f) any of the events referred to in this clause may have occurred or are likely to occur; or
(g) it is required by law to do so or requested or required to do so by the police, by any regulatory authority or law enforcement agency, or by a court.
5.2 In addition, Lottoland shall be entitled to suspend the relevant Player Accounts and Players from the use of the Website, if Lottoland believes that:
(a) any details of the Bank Account or Bank Card were, or have become, incorrect or the card is reported as lost or stolen or becomes the subject of fraud;
(b) it has received a negative appraisal of creditworthiness for a Player or any direct debit collection due from a Player is returned for reasons attributable to the Player;
(c) the Player has used a payment instrument without the owner's approval; or
(d) the Player has allowed a third party to place Bets or Enter Games using their Player Account.
5.3 During the period of any suspension of a Player Account the Player will be prevented from accessing or using their Player Account; in addition, Lottoland may investigate the event that gave rise to the suspension and Lottoland will be entitled (but shall not be obliged) to require that the relevant Player provides all such identification documents or other information as Lottoland reasonably requires.
5.4 Should Lottoland determine that the event giving rise to suspension has occurred, Lottoland will be entitled to terminate the Player Account in question permanently and may choose to do so once any outstanding Stakes associated with that Player Account for future Bets or Entries expire or otherwise may at its discretion void such Bets or disqualify Entries issued or played. If the Stake was placed by a Player under 18 years of age, Lottoland shall void the relevant Bets or disqualify Entries in which case the Stake will be returned from Lottoland to that person's Bank Account and the Player Account will be closed.
5.5 Should Lottoland determine that a breach has not occurred, the suspension of the Player Account will be brought to an end.
5.6 If Lottoland terminates a Player's use of the Website for any other reason, Lottoland will notify the relevant Player by email using the email address provided to Lottoland. In such circumstances, Lottoland shall refund the payable balance held on the Player Account to the Player, after both Stakes and any fees incurred have been deducted, and Winnings for all the future and open Bets and Entries have been settled, using the Bank Account provided by the Player.
5.7 Lottoland may withhold or delay payment of a Player’s funds or cancel any Winnings from a Player if, Lottoland deems in its absolute discretion that:
(a) there may be chargebacks in respect of the relevant Player Account;
(b) the Winnings stem directly from a chargeback; or
(c) the Player has partaken in any form of bonus abuse, cheating, fraud or taken advantage of any software or system bug, malfunction or failure.
6.1 Lottoland reserves the right to:
(a) set off against a Player's Winnings the amount of any unpaid Bets or Entries owed by that Player to Lottoland; or any Related Body Corporate;
(b) terminate, vary or suspend any Player Account, immediately and without prior notice, for any other reason at Lottoland’s sole discretion; and
(c) require that the relevant Player provide identification documents or other information in order to enable Lottoland to satisfy itself as to the validity of Player Account details and the Player’s entitlement to the Winnings in accordance with these Terms and Conditions. Lottoland may withhold payment of Winnings until any such matter has been resolved entirely to its satisfaction.
7.1 Lottoland reserves the right to make changes or corrections to, suspend or discontinue any aspect of the Website and the content or services or products available through it. Such changes shall not be applied retrospectively and in the event that such changes affect live Bets or Entries, Lottoland shall be entitled to void such Bets or disqualify such Entries and the Stakes shall be repaid to the Player Account.
7.2 The Player acknowledges and agrees that Lottoland is not responsible, and the Player will not hold Lottoland liable, for the content on any promotional links or advertising banners of third party advertisers and the Player takes sole responsibility for accessing, using or relying on those links or banners.
7.3 Players must not misuse the Website by introducing viruses, trojans, worms, or other material that is malicious or harmful. Lottoland will not be liable for any loss or damage to any Player caused by a distributed denial-of-service attack, viruses or other harmful material that may infect a Player's computer equipment, computer programs, data or other material while using the Website or any website linked to it.
7.4 While Lottoland endeavours to ensure that the information on this Website is correct, Lottoland does not warrant the accuracy or completeness of it. The Website may contain errors or inaccuracies, or information that is out of date.
7.5 The contents of this Website (including these Terms and Conditions and the Rules) are protected by international copyright laws and other intellectual property rights. The owner of these rights is Lottoland Related Body Corporates or other third party licensors. All products and company names and logos mentioned on this Website are the trademarks, service marks or trading names of their respective owners, including Lottoland. Players are permitted to print and download extracts from this Website only for their personal reference, and only provided that:
(a) no documents or related graphics on this Website are modified in any way;

(c) the status of Lottoland (and of identified contributors) as the author of any material on this Website is acknowledged.

8.2 It is acknowledged and agreed that Lottoland may record all conversations involving discussions relating to Bets or Entries, complaints or disputes, regardless of the medium.
9.1 Any complaints which a Player may have in relation to the use of the Website, their Player Account or any claims or disputes relating to any past or current transaction (including any Bet or Entry by that Player), must be dealt with in accordance with Lottoland’s complaints procedure as set out in this condition.
9.2 Lottoland’s complaints procedure has three levels. For level 1 to 3 the Player may contact Customer Service via email to the following address: [email protected]. Each correspondence shall be marked as “Complaint” and shall receive a reference number, provided that Lottoland has allocated a reference number to the relevant complaint.
9.3 At level 1 the complaint will be dealt with by an employee from Customer Service. At level 2 the complaint will be dealt with by the Head of Customer Service. In level 3 the complaint will be dealt with by the legal department of Lottoland.
9.4 While every effort will be made to ensure their concerns are dealt with, should a Player remain dissatisfied (the complaint is now a “Dispute”), they can:

9.5 The Player acknowledges and agrees that Lottoland may record all conversations involving discussions relating to complaints or Disputes, regardless of the medium.
10. 1 In the event of a complaint or Dispute in respect of a Bet or Entry or the payment or awarding of any Winnings, Lottoland may withhold payment of the Winnings until any complaint or Dispute has been resolved to its reasonable satisfaction.
10.2 Where Lottoland makes a final decision or exercises any discretion referred to above Lottoland may, solely at its discretion and notwithstanding Condition 9, reimburse the sum paid by the Player for the relevant Bet or Entry or offer a new Bet or Entry to the Player.
11.1 Lottoland will not be liable to a Player or third parties, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise, for:
(a) any loss of revenue, business, anticipated savings or profits (whether direct or indirect); or
(b) any indirect, special or consequential loss, damage, costs, expenses or other losses or claims, howsoever caused or arising, whether through non-supply or late supply of the Website or any other service available through the Website, non-performance of these Terms and Conditions or otherwise.
11.2 Nothing in these Terms and Conditions affects Lottoland’s liability for cases of death or personal injury due to negligence of Lottoland.
11.3 Without prejudice to any other provision of these Terms and Conditions, Lottoland shall not be liable to any person, for:
(a) any event beyond its reasonable control including without limitation, any act of God, actual or threatened war or other threat or challenge to governmental authority, confiscation, nationalisation, requisition or destruction of or damage to property by or under the order of any Government or public or local authority, strike, lockout, industrial action, fire, flood, drought, tempest, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service;
(b) the failure of, or damage or destruction to, or any errors caused by the computer systems or records or any third party (including, without limitation, the Website), or any aspect of the foregoing;
(c) delays, losses, errors or omissions in or made by the postal, telecommunication or other delivery service or by the banking system;
(d) any other action or event that prevents or hinders the acceptance of a Bet or Entry;
(e) the refusal to sell a Bet or Entry to any person or to allow any person to place a Bet or Enter Games; or
(f) any losses caused to Players including misuse or unauthorised use of passwords, money lost by placing Bets or Entering Games and failure or malfunction of the equipment or technology of the relevant Player or their Internet service provider.
12.1 Lottoland endeavours to ensure that the Website and the services available through it are available to Players as much as is reasonably possible, but Lottoland cannot and does not guarantee that:
(a) the Website will be available at any specific time or for any specific period;
(b) the Website's features, functionality or performance will meet the Player's requirements or those of third parties; or
(c) the Website or its features and functionality are, or will be, compatible with, or available on, the device or system used by a Player to access the Website.
In addition, Lottoland does not warrant that any alerts or advices a Player may choose to subscribe to will be provided in advance of the deadline for instructing Lottoland to accept a Bet or Entry and shall have no liability to a Player if any such alerts or advices are incorrect or delayed or are not sent to or not received by the Player.
12.2 Lottoland will use reasonable endeavours to ensure that the results and Winnings provided by it are correct. In spite of all endeavours for warranty of the accuracy of this information Lottoland shall have no liability for errors or mistakes which are discovered only after Winnings have been paid out where such error or mistake is based on incorrect information that is published by a relevant publisher of that information relevant to those Winnings.
12.3 Lottoland will not accept responsibility for loss or damage because of the insolvency of third parties, including banks maintaining the bank accounts of Lottoland.
12.4 Lottoland shall not be liable for any loss or damage that may arise from the insolvency of third parties, including any third party supplier or any bank, including (without limitation) any bank with which a third party supplier maintain their accounts.
12.5 Lottoland is not obliged to pay Winnings if the Player has no such claim according to these Terms and Conditions or the relevant Rules.
12.6 Any liability that Lottoland has towards a Player other than an obligation to pay Winnings to the Player for successful and valid Bets and Entries submitted and accepted by Lottoland according to these Terms and Conditions is limited:
(a) in the case that the liability refers to a Bet, to the total amount of the Player’s Stake in regards to that specific Bet;
(b) in the case that the liability refers to an Entry, to the total amount of the Player’s Stake in regards to that specific Entry; and
(c) in all other cases, to the amount which is the lowest of:
(i) AUD 5,000.00; and
(ii) the aggregate sum which the Player has Staked in the last 30 days.
13.1 The agreement between the Player and Lottoland in regards to this Website and the therein offered services is constituted by:
- these Terms and Conditions;
- the Rules;
- the explanations and clarifications appearing on the Website from time to time; and
- any applicable changes to any of the above from time to time.

15.5 All notices under these Terms and Conditions are to be sent and received by email. For this purpose, Player notices should be sent to Customer Service. Lottoland will send its notices to the Player at the email address specified in the Player's Player Account.
15.6 Lottoland may, but Players may not, assign any rights and/or transfer, sub-contract or delegate any obligations under these Terms and Conditions, and/or charge or deal in any other manner with any contract created under these Terms and Conditions or any of Lottoland's or the Player's respective rights or obligations. For the avoidance of doubt, Lottoland may transfer and assign any contract between Lottoland and a Player to any third party (including a Related Body Corporate of Lottoland) in conjunction with the transfer of all or part of the business and assets of Lottoland.
15.7 Any purported assignment, transfer, sub-contracting, delegation, charging or dealing in contravention of these Terms and Conditions by the Player shall be invalid and ineffective. These Terms and Conditions are personal to the Player and are entered into by the Player for their own benefit and not for the benefit of any third party.
15.8 Any omission to exercise, or delay in exercising, any right or remedy under these Terms and Conditions shall not constitute a waiver of that, or any other, right or remedy. The waiver by Lottoland of any of its rights or remedies arising under these Terms and Conditions or by operation of law shall not constitute a continuing waiver of that right or remedy or a waiver of any other right or remedy.
